TERMS AND CONDITIONS FOR ADDITIONAL SERVICES AND PRODUCTS

Terms and conditions for additional services and products of LazyFriday s.r.o. for LazyFriday catio service

1. Establishment and conditions of the contractual relationship

1. 1. These General Terms and Conditions for additional services and products are concluded between the Customer and the Provider on the basis of the provisions of subsequent regulations.

1. 2. The Provider of the services offered on the website LazyFriday s.r.o. - LazyFriday catio (www.catio.cz) is:

hereinafter referred to as the Provider .
 

1. 3.  Responsible manager: Lukáš Verčík, e-mail: ceo@lazyfriday.cz, tel. 606 025 288 Hereinafter referred to as: Responsible manager.
 

1. 4. Catio nanny: A natural person in a contractual relationship with the Provider performing pet-sitting services under the LazyFriday catio brand. Hereafter referred to as the Nanny .
 

​1. 5.  Customer: customer means a natural person who orders and or uses services under the LazyFriday catio brand at LazyFriday s.r.o. Hereinafter referred to as: the Customer .

2. The provision of additional services

2. 1. Payable additional services are ordered by the Customer separately, above the price of the selected tariff. However, some add-ons are performed at the time of the purchased tariff and therefore are not beyond the stated tariff time, as described in the description of the add-on.

 

2. 2. The Provider, represented by the Nanny and the subcontractors LazyFriday s.r.o., undertakes to perform the additional services in a careful, professional manner, with the best knowledge and conscience.

 

2. 3. The selected additional services are specified in the "Pet-sitting Agreement", and at the same time in the electronic platform Roza and the Customer by signing this agreement agrees to perform the selected additional services.

3. Add-ons

3.1. Add-on "Small household help"

3. 1. 1. The add-on "Small household help" is an additional service to the price of the purchased tariff and is completely free of charge..
 

3. 1. 2 . The Add-on "Small household help" can be ordered on the Roza platform or via the Provider's customer support.

3. 1. 3.  The Provider reserves the right to modify, partially execute or not execute the add-on "small household help" at all. In case of non-performance of the add-on, the Customer is not entitled to any compensation

3. 1. 4.   Within the scope of the add-on, the Nanny is obliged to provide minor household help, namely taking out the garbage, watering the flowers, airing and collecting mail from the mailbox.

3. 1. 5.  When taking out the rubbish from the household, the Nanny shall take out ordinary mixed rubbish only if it is possible to take the rubbish to a designated place within 200 m of the place of service.

3. 1. 6.  In the case of sorted waste, the Nanny only takes out sorted waste whose containers are located within 200 m of the place of service.

3. 1. 7.  The removal of waste does not apply for bulky, hazardous, special handling and sensitive waste. The assessment of whether waste falls into any of the listed categories is at the sole discretion of the Provider, represented by the Nanny.

3. 1. 8.  In order to carry out the care of flowers, the Customer is obliged to provide the information necessary to procure flowers in the home.

3. 1. 9.  The Provider reserves the right to waive the care of flowers that need extra care, high value, toxic, allergenic, or otherwise dangerous flowers. The assessment of whether waste falls into any of the listed categories is at the sole discretion of the Provider, represented by the Nanny.

3. 1. 10.  The Provider shall not be liable for the condition of the flowers or for their death or damage.

3. 1. 11.  When performing mail pickup, mail pickup occurs only at the pet sitting location of performance, which is the Customer's apartment mailbox or home mailbox.

3. 1. 12.  The Nanny is not allowed to pick up registered mail, mail with a blue or other coloured stripe, mail with COD, high value mail.

3. 1. 13.  The Nanny is not allowed to open the received mail and thus look into the contents of the mail.

3. 1. 14.  In the event that a notice for picking up the mail is left in the mailbox, the Nanny shall take the notice from the mailbox and place it in a predetermined place in the apartment / house, which the Customer has previously specified for this action.

3. 1. 15.  The Add-on "Small household help"  the Nanny performs the entire period of the purchased pet-sitting tariff and this supplement is performed at the time of the purchased pet-sitting tariff.

3. 1. 16.  The Add-on "Small household help"  shall be performed by the Nanny in such a way that the quality of care for the pet is not compromised.

3.2. "Care of other pets" add-on

3. 2. 1. The  add-on "Care for other pets" is an additional service in addition to the price of the purchased tariff and is completely free of charge. 
 

3. 2. 2.  The  add-on "Care for other pets" can be ordered on the Roza platform, or via the Provider's customer support

3. 2. 3.  This add-on covers the basic care of other pets in the household, namely fish, rabbits, guinea pigs, hamsters, gerbils, chinchillas, turtles, small lizards, parrots and other common birds, small dogs and cats if they share a household with a cat.
 

3. 2. 4. The Provider does not provide care for exotic, poisonous, protected, endangered, or health-threatening pets. The determination of whether a pet falls into any of the listed categories is solely at the discretion of the Provider.

3. 2. 5. The Customer shall inform the Provider in advance of any other pets present in the household and provide all information necessary to care for them. This information shall include which pets are involved, their species, their exact number, their health status. Also the schedule needed to ensure their care - feeding, cleaning, socialisation.

3. 2. 6. The time spent during veterinary treatment is not included in the time of the purchased tariff and the Customer is obliged to reimburse the Provider for this increased time of the Nanny in the amount of CZK 500 for each one hour started. The additional payment is charged in 15-minute blocks, where even a started block is taken as a whole block.

3. 2. 7.  If there is an error in the performance of care of the pet by the Provider and this error results in the need for veterinary treatment of the pet, the Provider shall pay for this treatment under the "Insurance of entrepreneurs and legal entities" with Allianz pojišťovna a.s. with a limit of coverage CZK 20,000,000.

3. 2. 8 . The add-on "Care for other pets" the Nanny performs pet-sitting for the entire period of the purchased tariff.

3.3. "Small purchase at your request" add-on

3. 3. 1. The add-on "Small purchase at your request", hereinafter referred to as the Purchase, is an additional service whose price is added to the price of the pet-sitting tariff, according to the actual price list available on the Roza platform and on the LazyFriday catio website (www.catio.cz).

3. 3. 2. The add-on "Small purchase at your request" add-on can be ordered on the Roza platform, or through the Provider's customer support.

3. 3. 3.  The Provider reserves the right to refuse, limit, modify the performance of this add-on at any time without prior notice and compensation

3. 3. 4. The Provider reserves the right, at its sole discretion, to modify the contents of the shopping list.

3. 3. 5.  The maximum purchase value is limited to CZK 400.

3. 3. 6.The Customer is obliged to pay the price for the purchase, after submitting the receipt, no later than 3 working days after the end of the pet-sitting service to the Provider's account 2501524194/2010. The Customer shall indicate the order number as the variable symbol.

3. 3. 7.One piece of the ordered add-on is one purchase in one grocery or pet supplies store in the nearest vicinity of the pet-sitting location. Thus, it is not possible to combine on one piece of supplement with multiple visits to supermarkets, stores, etc.

3. 3. 8. The Provider reserves the right to choose the store and to change the store at any time without prior notice.

3. 3. 9. The purchase is limited to a maximum of 10 items with a maximum total weight of 4 kg.

3. 3. 10. The add-on does not apply to the purchase of alcoholic and tobacco products.

3. 3. 11. In the event that a product from the shopping list is not available, the Provider reserves the right not to supply that product from the list or to supply a similar product.

3. 3. 12. The purchase is handed over to the Customer if the Customer is at the place of pet-sitting. If it is not possible to hand over the purchase directly to the Customer, the purchase is placed in the appropriate places (kitchen, fridge, pantry), after prior agreement between the Nanny and the Customer.

3. 3. 13. The Provider is not responsible in any way for health or other problems that the purchased products may cause. The Provider is not responsible for the condition of the product, its contents, appearance and usability. The Customer assumes full responsibility for any problems and waives any compensation.

3. 3. 14. The Customer shall disclose to the Provider his/her allergies and those of household members who will consume or use the items on the shopping list. The Customer is also obliged to disclose any other health limitations that may be affected by the consumption or use of the products. 

3. 3. 15. The original receipt of purchase is handed over ( left) to the Customer. A copy of the receipt of purchase is retained by the Provider. This copy is included in the Customer's billing/invoice for the surcharge.

3. 3. 16. The Customer simultaneously waives any claim for payment of damages related to the occurrence of possible health or other problems, the condition of the product, the usability of the product, the contents of the product.

3. 3. 17. A maximum of 3 pieces of the add-on can be purchased per order for pet-sitting.

4. Prices

4. 1. The price of add-ons is defined according to the currently valid price list on the Roza platform and on the LazyFriday catio website (www.catio.cz).

4. 2. The parties may also agree on a different individual price for the additional services provided if mutually agreed. The provision of an individual price is at the sole discretion of the Provider. The Customer shall have no legal entitlement to an individual offer.

5. Mandatory consumer information

5. 1. In relation to the Provider, the Customer does not incur any costs for the use of means of distance communication. 

6. Unpaid surcharges

6. 1. If the Customer fails to pay the balance (value of the purchase) within 3 days of the end of the pet-sitting, the amount due shall bear interest at the statutory default rate plus 5% of the amount due, including any additional charges for each day of delay.

6. 2. The Provider reserves the right to apply a contractual penalty of CZK 5,000 for a delay in payment of more than 30 calendar days. If the penalty is not paid within 3 calendar days of issue, the penalty shall bear interest at the statutory default rate plus 5% for each day of delay. This penalty shall not affect the payment of the amount due, including the accessories

6. 3. The Provider reserves the right to make an exclusive decision at any time to recover, waive all or part of the amount due.

7. Liability for damage

7. 1. The Customer hereby expressly waives the right to claim damages from the Provider inadvertently or not grossly negligently caused by the Provider's breach of any obligation of the Provider specified in the Contract in connection with the performance of the Contract or these Terms and Conditions.

8. Protection of personal data

8. 1. The processing of personal data is governed by the privacy and confidentiality policy available at https://www.catio.cz/obchodni-podminky/zasady-ochrany-osobnich-udaju/

9. General provisions

9. 1. Other matters not mentioned herein shall be governed by the Civil Code (No. 89/2012 Coll.), the Consumer Protection Act (No. 634/1992 Coll.) and other legislation, as amended.

9. 2.  Supervision of compliance with the obligations under Act No. 634/1992 Coll., on Consumer Protection, as amended, is carried out by the Czech Trade Inspection Authority (www.coi.cz).

9. 3.  The wording of these General Terms and Conditions is binding on both parties.

10. Governing law

10. 1. These Terms and Conditions, as well as the contract and the "Pet-sitting Agreement", are governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll., Civil Code, as amended.

10. 2. Any disputes arising under the Contract or these Terms and Conditions shall be decided by the courts of the Czech Republic having jurisdiction in the matter and place.

11. Effectiveness

11. 1. These Terms and Conditions shall come into force and effect on 15. 05. 2022.
